By downloading, installing, or using BrainBeat, you agree to be bound by these Terms of Service. If you do not agree, do not use the app.

2. Description of Service

BrainBeat is a language learning application that uses binaural audio technology to support vocabulary acquisition and memory reinforcement. The app provides audio sessions with specific sound frequencies designed to complement the learning process.

3. Important Health Disclaimer

BrainBeat is NOT a medical device. It is not intended to diagnose, treat, cure, or prevent any medical condition. The binaural audio technology is designed to support general well-being and learning enhancement.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account.

5. Subscriptions and Payments

BrainBeat offers both free and premium subscription plans. Premium subscriptions are billed through the Apple App Store or Google Play Store. Subscription terms, including auto-renewal and cancellation policies, are governed by the respective store's terms.

6. Intellectual Property

All content in BrainBeat, including but not limited to audio, text, graphics, and software, is owned by BrainBeat or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the app.

7. User Content

Your learning data (progress, session history) is stored securely and used solely to provide and improve the service. We do not share your learning data with third parties for marketing purposes.

8. Limitation of Liability

BrainBeat is provided "as is" without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the app. Our total liability is limited to the amount you paid for the service in the 12 months preceding the claim.

BrainBeat does not guarantee specific learning outcomes or language acquisition results.

9. Governing Law

These Terms are governed by the laws of Portugal. Any disputes will be resolved in the tribunais de Lisboa, Portugal, or the competent courts of the user's country of residence within the EU.

10. EU Online Dispute Resolution

For consumers in the European Union, disputes may be submitted to the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the app after changes constitutes acceptance of the modified Terms.
